Recently the New York Attorney General's office worked with Metro Mattress in an effort to end what was described as "fake sales." Metro's sales practices were being quietly investigated for months before an agreement was reached. Metro was continually advertising the same products as being sale priced, with urgent advertisements telling consumers that they would never see such prices again. The point of the ads was to get people to buy, thinking they were getting a great bargain.
The Attorney General stated that this was not fair to consumers, as the supposed low prices continued after the "sale" had ended. New York state law forbids an item from being marked as "on sale" unless it has been sold at a regular price for a period of time. Metro was also found to be neglectful in tagging sale priced items, making it difficult for shoppers to tell just exactly what was on sale. It also compared its own sale prices to those of stores that did not exist. Customers were fooled into thinking they were receiving a bargain when they were actually paying full price.
Clean Act
In an effort to clean up their act, Metro Mattress agreed to stop advertising items as being on sale unless they had been available at their store at a non-sale, regular price for a decent interval. Metro also promised that all sale items would be prominently marked with their prices. Metro Mattress also will pay civil penalties and fines and make restitution to over 200 customers who were affected by their fraudulent sales practices.
Although they do not agree that they violated any laws, Metro Mattress will now advertise their mattresses, beds, and futons at the correct price, stop running misleading advertisements, and generally become a good place to find a wide selection of mattresses and beds.
